
A better approach would have been to approach from the street side, point the front of the car at the curb, and use the car doors for cover. The cops would then order the kid to walk toward them with his hands in view. They would prone him out about midway between the gazebo and the sidewalk. Then, one officer would approach to handcuff and search while the other provided cover.
The way they did it, the passenger officer had no cover and no option other than to shoot or wait to get shot.
I don't like to second-guess the actions of other cops, but I see no excuse or explanation for the way the driver handled this.
