If any unknown dog runs at a person barking they are completely within their rights to make the assumption the dog is going to attack regardless of size. I don't know your dog. I do know that small dogs bite just like big dogs. I do know the dog is not under your control so you cannot stop it before it does anything. I do know I have the right to protect myself from harm.
You refuse to control your dog. You refuse to train your dog because "we do not have the tools or skills set to train our 6 year old Yorkie". (from your comment on Mike Wilhelm's answer) You refuse to keep your dog that you can't control and will not train on a leash in a public place because "It would be unfair to have her leashed all the time." (also from a comment on Mike Wilhelm's answer). How other people react to your dog's behavior is appropriate.
The leash laws in your country don't even matter in this case. In my opinion, you are not responsible enough to own a dog.
