Hypothetical Scenarios: You are walking your Yorkshire terrier when a jogger passes, your dog barks and runs at them, but does no more. The jogger kicks your dog. Would you attack the jogger?

It's good to know your dog has never bitten anyone. I'm sure you will be saying that the first time she does bite someone and animal control takes your dog and you have to pay for the medical bills for the victim.

If any unknown dog runs at a person barking they are completely within their rights to make the assumption the dog is going to attack regardless of size. I don't know your dog. I do know that small dogs bite just like big dogs. I do know the dog is not under your control so you cannot stop it before it does anything. I do know I have the right to protect myself from harm.

You refuse to control your dog. You refuse to train your dog because "we do not have the tools or skills set to train our 6 year old Yorkie". (from your comment on Mike Wilhelm's answer) You refuse to keep your dog that you can't control and will not train on a leash in a public place because "It would be unfair to have her leashed all the time." (also from a comment on Mike Wilhelm's answer). How other people react to your dog's behavior is appropriate.

The leash laws in your country don't even matter in this case. In my opinion, you are not responsible enough to own a dog.

EDIT: As I have now discovered where this dog owner is located, Ireland according to a comment on Fay Mahdi's answer, we can have some hope that the authorities will take her dog under the laws of Ireland.
Stray dogs are dogs that are in a public place and are not accompanied by the owner or a responsible person. Dogs that are not under proper control are also considered stray dogs. You can receive an on-the-spot fine if your dog is not under proper control. Stray dogs may be seized by the dog warden and the Gardaí and brought to a dog pound. These dogs may be put down or re-homed if their owners do not claim them within 5 days.
