In all things like this, it depends. If the invader is in the process of running out of your house, I wouldn’t recommend it. There is an old saying. If you shoot someone in your home, you better hope he falls inward. Of course, what state you are in and the specific laws in that state will impact what you can do.
Now, if the invader is going towards your child’s bedroom and you shoot him in the back, you have a heck of a better argument for why you did it as opposed to when the invader is fleeing your home.
