Because she's Hillary Clinton, the presumptive nominee of the democratic party for the United States, and the justice department is run by democrats.
There are many inaccurate answers here. I'll summarize some of the common misconceptions and outright lies that are being used to defend her.
- Hillary Clinton did nothing unusual. False. Running a private e-mail server for ones personal use is highly irregular. While this has been compared to occasional incidental use by primor secretaries of state, the two situations aren't comparable. Colin Powell and Condoleezza rice did not use personal e-mail servers at all. While they did on rare occasion receive work related e-mail to personal e-mail accounts, it was not their primary mode of communication. This is the difference between getting the occasional work related e-mail at your personal g-mail account, vs. standing up your own server and not even having a work e-mail. This has also occasionally been compared to the fact that the Bush administration also used non government e-mail. However, again, this is completely different. Bush's use of non-government e-mail was an attempt to make sure that campaign related communications was not sent over government systems (which is illegal), not to keep government business on private servers, outside of disclosure laws. Extensively using a personal e-mail server for company business is highly unusual, in any industry or any capacity. While former secretaries of state may have only modestly used e-mail, if at all, Clinton received 60,000 e-mails to her clintonemail . com address, and she considered 30K of these to be work related. That's a LOT of email.
- Hillary Clinton never received classified e-mail on that server. False. While we can debate endlessly if certain material was properly classified, at least in some cases, CLEARLY classified e-mail was sent to her personal server. She took no action to prevent it. Even Slate, hardly a conservative news organization, agrees that she received classified e-mail to that server in at least some instances:A Crystal-Clear Explanation of Hillary Clinton's Confusing Email Scandal. - Her server was secure. Almost certainly false. Her server had an open webmail portal to an exchange environment, a notorious security hole. Her server was nothing more than a windows box running exchange. It wasn't anything special.
- She only had the server to keep from carrying multiple devices. False. It's well document that she carried many devices.
In conclusion, it's hard to make a reasonable case that Hillary Clinton didn't break the law. Even if one can make a hyper technical case that she did not, she clearly used such incredibly poor judgement that to seriously consider her for running anything more than a hot dog stand is deluded.
